Important update for ALL Massachusetts Employers

MANDATORY POSTER UPDATE

Note that all employers must update their workplace posters to reflect a change made to the maternity leave law.  All ConnectPay clients can view information on this in our HR Helpline portal, which you receive from us for FREE.  If you are not a client of ConnectPay, ask your payroll company if they have an HR site included.  If not, you should consider switching your payroll compliance to ConnectPay.  If you need to purchase a new poster with the appropriate language, please don’t hesitate to contact me.

Employers now must also post a notice specific to their company’s policy on parental leave. This information must be provided by the employer themselves with their own specific company policy.

Law in Effect

On January 7, 2015, the governor of Massachusetts signed into law a new Parental Leave Law (MPLA). The MPLA became effective yesterday, April 7, 2015, and provides 8 weeks of parental leave for the birth or adoption of a child for any full-time employee who has completed 3 months of employment and who works for a MA employer with six (6) or more employees. An employee seeking maternity leave must give two weeks’ notice of her anticipated date of departure and intent to return. This law effectively replaces the existing Massachusetts Maternity Leave Act, which previously provided leave time only for women, and provides essentially the same leave entitlement on a gender-neutral basis. Should both parents work for the same employer, however, they are only entitled to 8 weeks of parental leave in aggregate and are also required to give the two weeks’ notice of intended leave date and date of return. The leave may be provided with or without pay at the discretion of the employer. Posting of the employer’s parental leave policy is required.
